The initial intent of this particular Thor’s Day discussion was to discuss the damage done by false sexual assault claims. What emerges is a study in how two intelligent people can view the reality of justice and the validity of data collected in a world that is most often thought to be black and white in nature. Life and reality are more active in the grayscale.

A lot of the two hours was dominated by a heated debate that we leave to the listener’s judgment.

Perhaps we can all agree that much can be done to improve all the situations described.

Are statistics and data from the American legal system a fair representation of reality?

    I usually listen to your JFK talks but this was interesting! It prompted me to go to look at the stats for the U.K. In 2011 to May 2012, there were 5651 prosecutions for rape and 35 for false allegations of rape ( Charging Perverting the Course of Justice and Wasting Police Time in Cases Involving Allegedly False Rape and Domestic Violence Allegations a Joint report by Alison Levitt QC, Principal Legal Advisor and CPS Equality and Diversity Unit). I found it on’s website. The figures are for England and Wales. Interestingly, if you look at the prosecution number compared to the stats for reported rapes very few get to court here, which is an ongoing problem. I sit somewhere between the two of you because as a woman, I think rape is underreported but as a mother of a son, I’m aware there are false allegations. In the above mentioned report, there are reports of individual cases which are just as harrowing as the ones Carmine read out.
    Anyway, keep up the good work; I look forward to more JFK reports.
